The regular meeting of the City of Scotland was called to order by Mayor Randy Thum at 5:00pm on Monday, May 11, 2026. The following council members answered to roll call Randy Abbink, Wayne Bertrand, Amanda Fischer, Victor Settje and Dennis Bietz. Those council members absent were Tim Asche. Others present were Tanya Bult, Domm Pechous, Zach Clifton, Peggy Schelske and Kent Lehr (5:04pm).

Finance Officer Report - SAA is installing a new fence at the baseball field with hopes to be finished by June 14th for sports day. Garbage rates will increase .50 cents per can just while fuel is higher. The additional fee will not be passed onto the residents. Roll-off for city wide cleanup went over well. Bult asked the council to consider doing another week in September. This is our 24th consecutive year receiving the Secretary’s Award for Drinking Water Excellence. Pet registration is due by the end of May. Currently 12 of 57 cats are registered and 52 of 227 dogs are registered.
Library Report - Summer hours begin on May 18, 2026 at 10am. Library board meeting on May 18, 2026 at 7pm. Mark your calendars for the summer reading program every Thursday morning in July.
Maintenance Report - Been busy mowing, weed eating, discharged the lagoons and started cleaning the pool.
Police Report - April calls for service: civil dispute (4), agency assist (2), Welfare check (1), assault (1), animal complaint (5), code enforcement (2).
Council Concerns/Committee Reports:
Abbink - Ordinance with mowing your grass clippings onto the roadway.
Fischer - Questioned spraying at park with the last day of school “fun day” being held at park.
Settje - Requested an update on the bumps from the Hwy going onto Main Street and the sidewalk. Stated the approaches onto Stafford Street off Dollard Street needs some attention.
Bietz - Receiving safety complaints regarding a tree down blocking view on Conklin/Third Street. Hearing concerns of golf carts on public streets not abiding by traffic laws with possible under age drivers.
A motion was made by Abbink, second by Bertrand to approve the second reading of the Chapter 5 Animals Ordinance #2026-01. The motion carried by the following vote: Yes: 5 - Abbink, Bertrand, Fischer, Settje, Bietz.
AN ORDINANCE AMENDING THE PROVISIONS OF TITLE 5A.03, REGULATION OF ANIMALS IN GENERAL BY AMNDING 5A.0302 OF THE MUNCIPAL ORDINANCES OF THE CITY OF SCOTLAND, BON HOMME COUNTY, SOUTH DAKOTA.
BE IT ORDAINED BY THE CITY OF SCOTLAND, BON HOMME COUNTY, SOUTH DAKOTA AS FOLLOWS: That Section 5A.0302 entitled Destruction of Animals Running At Large, of Chapter 5A.03 entitled Regulation of Animals in General, of the Revised Municipal Ordinances of the City of Scotland be repealed in its entirety to be replaced by Section 5A.0302B entitled Impoundment and Disposition of Animals, to read as follows:
5A.0302B Impoundment and Disposition of Animals
5A.0302.10 - Impounding procedure.
It will be the duty of the official(s) to seize, catch, or retrieve animals in violation of this chapter and cause the same to be impounded in the place provided for that purpose. Impounding will be carried out in the following manner:
The official(s) will make out a prenumbered ticket for each animal. The Police Department will keep the original ticket and notify the Dispatch Center to log the fact that an animal was impounded along with a brief description of the animal.
5A.0302.11 - Diseased or rabid animals not released.
Any animal which appears to the official(s) to be suffering from rabies or other infectious disease will be required to be treated at the owner's expense before being released. If the owner is unknown or refuses to pay the cost of treatment and the animal appears to be suffering from an infectious disease or rabies for a period of seventy-two (72) hours, then the animal may be destroyed without additional notice or court hearing regarding its destruction.
5A.0302.12 - Seventy-two hours determined reasonable.
In the event no owner or person can be found and served with a notice of destruction or disposition of an impounded animal, then it is determined that seventy-two (72) hours is a reasonable period of time for the City to hold an animal in impoundment before destroying or disposing of such animal or finding an acceptable home for the animal per Section 5A.0302.13.
5A.0302.13 - Destruction of animal—Placement—Exception—Not to sell.
If an animal is not claimed within seventy-two (72) hours, then the animal may be destroyed in a humane manner following proper notice to the owner (See Section 5A.0302.15. In lieu of destruction, at the discretion of official(s), an acceptable home may be found for any animal kept impounded for more than seventy-two (72) hours in which case a record will be kept of the date, name, address, and telephone number of the person in whose home the animal is placed. The official(s) will have discretion in determining the adequacy of the adopting home. In no case are the Poundmaster or official(s) authorized to sell animals which have been impounded.
5A.0302.14 - Destruction of animal at owner's request.
The owner of an animal impounded under the provisions of this chapter may present to official(s) a dated and signed written request that the dog or animal be destroyed.
5A.0302.15 - Notice—Impoundment—Destruction—Placement in home.
When an animal is impounded, the impounding official will, as soon as possible, attempt to make either personal or telephone contact with the owner of the animal, advising them that they must comply with the City ordinance, that if the animal is not claimed within seventy-two (72) hours of the time of impoundment the animal will be either destroyed in a humane manner or placed in an acceptable home in accordance with Section 5A.0302.13 of this chapter. All attempts to contact owners will be accurately and carefully logged at either the Police Department or dispatch center and retained as part of the police records on the animal.
Unlicensed animals whose owners are unknown and all other impounded unclaimed animals may be destroyed or placed in homes without notifying the owners after the same have been held for seventy-two (72) hours.
5A.0302.16 - Release procedure—Dogs and other animals.
The owner of a dog or animal may obtain its release by:
A. Presenting proof that a dog has been vaccinated by a person authorized by law to administer rabies vaccinations for rabies within the last two (2) years; and
B. If the dog is unlicensed, obtaining a license; and
C. Paying the costs of impoundment with the Poundmaster for the dog or other animal; and
D. If the dog or animal is impounded for the fourth time in any twelve-month (12) period, it may be destroyed or placed in an acceptable home outside the City limits. Placement records must be kept as set forth in Section 5A.0302.13.

AN ORDINANCE AMENDING SECTION III. OF CHAPER 16.02, OF TITLE 16, ABANDONED, DERELICT AND JUNK MOTOR VEHICLES AND SCRAP METALS, WITHIN THE CITY OF SCOTLAND, BON HOMME COUNTY, SOUTH DAKOTA.
BE IT ORDAINED BY THE CITY OF SCOTLAND, BON HOMME COUNTY, SOUTH DAKOTA AS FOLLOWS: That Section III. of Chapter 16.02 of Title 16 entitled Abandoned, Derelict and Junk Motor Vehicles and Scrap Metals of the Revised Municipal Ordinances of the City of Scotland be Amended to read as follows:
Chapter 16.02- ABANDONED, JUNKED, DISMANTLED, OR INOPERATIVE MOTOR VEHICLES
Section III. STORING, PARKING OR LEAVING DISMANTLED OR OTHER SUCH MOTOR VEHICLES PROHIBITED AND DECLARED NUISANCE.
No person shall park, store or leave, or permit the parking, storing or leaving of any motor vehicle that is abandoned, inoperable or junked as defined in this article, whether attended or not, upon any public property or on any private property within the city for a period of time longer than thirty (30) days. The presence of an abandoned, inoperable or junked motor vehicle or parts thereof on private or public property is prohibited and hereby declared a public nuisance, which may be abated as such in accordance with the provisions of this ordinance. This section shall not apply to any motor vehicle that is:
(1) Totally enclosed within a building, or behind a solid fenced or screened enclosure approved by the city, the same being no less than eight (8) feet high on private property or leased public property; or
(2) On the premises of a business enterprise lawfully licensed by the State of South Dakota for sales, use, or excise tax purposes and properly operated in the appropriate business zone, pursuant to the zoning laws of the city, if any, and stored within a building, or behind a solid fenced or screened enclosure approved by the city, the same being no less than eight (8) feet high; or,
(3) In an appropriate storage place or depository maintained in a lawful place and manner by the city; or
(4) Designed for operation on a drag strip or raceway provided that such vehicle is properly stored during non-racing seasons.
(5) Any currently licensed seasonal lawn trailers, utility trailers, or camper trailers or motor homes.
