TRAFFIC REGULATIONS, MOVING AND NON-MOVING TRAFFIC

Chapter 6.01     General Regulations

6.0101     Speed Limits   

                It is unlawful for any person to drive a vehicle upon any public street or thoroughfare at a speed greater than 20 miles per hour, unless otherwise posted.

6.0102     Stop signs, Traffic Signs   

                It is unlawful for any person to disobey any traffic sign or posting where such sign or posting is placed by authority of the Chief of Police.  It is expressly provided hereby that the Chief of Police shall be empowered to post traffic signs or postings as are necessary for the conduct of safe traffic upon the streets and thoroughfares of the City of Scotland.  The duration or permanency of such posting shall be subject to the discretion of the City Council, once the posting is so made by the Chief of Police under this authority.

6.0103     Mufflers   

                It is unlawful for any person to drive a motor vehicle on a street or thoroughfare unless the motor vehicle is equipped with an exhaust system and a muffler both in good working condition and in constant operation to prevent excessive or unusual noise.  No person may use a muffler cut-out on any motor vehicle upon a street or thoroughfare.

6.0104     Passing at Intersections

                It is unlawful for the driver of any vehicle overtaking another vehicle to pass or attempt to pass the same at any intersection.

6.0105     Careless Driving

                It is unlawful for a person to drive any vehicle upon any street, alley, public park, recreational area or upon the property of a public or private school within the City of Scotland carelessly and without due caution, at a speed or in a manner so as to endanger any person or property.

6.0106     Exhibition Driving

                It is unlawful for a person to drive any vehicle upon a street, alley, public park, recreational area or upon the property of a public or private school within the City of Scotland in such a manner that creates or causes unnecessary engine noise, tire squeal, skid or slide upon acceleration or stopping; that simulates a temporary race; or that causes the vehicle to unnecessarily turn abruptly or sway.

6.0107     Expiration of license plates or validation stickers

                It is unlawful for a person to operate a motor vehicle without the current license plate displaying the proper validation sticker.

6.0108     Driving while license is suspended

                It is unlawful for any person to drive a motor vehicle on any street or thoroughfare at a time when his driving privilege is suspended.

6.0109     Driving while license is canceled

                It is unlawful for any person to drive a motor vehicle on any street or thoroughfare at a time when his driving privilege is canceled.

6.0110     Driving without a driver’s license

                It is unlawful for any person to drive a motor vehicle on any street or thoroughfare unless the person has a valid driver’s license.

6.0111     Open container in a motor vehicle  

                It is unlawful for any person occupying a motor vehicle located upon a public street, thoroughfare or right-of-way to consume any alcoholic beverage or have a package or any receptacle containing an alcoholic beverage in that person's possession unless the seal of the original package remains unbroken or the alcoholic beverage is so removed from the passenger area of the motor vehicle that no occupant of the motor vehicle has access to it

6.0112     Illegal Parking

                It is unlawful for the driver of a vehicle to turn a vehicle so as to park the vehicle on the opposite side of the street from the direction of travel.

6.0113     Use of engine compression brakes

                It is unlawful to use engine compression brakes in the city.

6.0199     Penalties

                Violations of Chapter 6.01 shall be a misdemeanor and upon adjudication of guilt the driver of any vehicle violating this ordinance shall be fined up to one hundred twenty five dollars ($125.00) per occurrence.
