Chapter 12.06 Excavations
12.0601 Requirements
It shall be the duty of every owner of any real property fronting or abutting on any street or avenue in the City of Scotland, to lay and construct sewer and water connections from the sewer and water mains in said streets or avenues to the curb line of their respective property, before the street or avenue upon which said property fronts or abuts is graded and paved.
In case any owner of any property fronting or abutting on any street or avenue as aforesaid shall fail, neglect or refuse to lay and construct sewer and water connections from the sewer and water mains on said streets or avenues to the curb line of their respective property as provided in this section, before said streets or avenues are graded and paved, then whenever any such person shall desire to make such connections after the grading and paving of said streets or avenues or whenever any such person shall desire to make any excavation in said streets or avenues after the said grading and paving has been done, for the purpose of repairing any sewer or water connection or for any other purpose he/she shall first secure a permit from the City Auditor and in addition thereto, he/she shall deposit with the City auditor the sum of two hundred dollars ($200) and upon said deposit being made the said City of Scotland shall, under the supervision of the City Engineer, take up said pavement wherever necessary and shall also replace or rebuild all pavement that may have been removed or disturbed in doing said work.
Said refilling of said excavation and removal and rebuilding of said pavement shall be done in a manner approved by the City Engineer, and at the expense of the owner or person for whom the said work is performed, including the expense of the City Engineer, and the City Auditor shall retain the amount of said expense, which shall be certified by the City Engineer to said City Auditor, out of the deposit hereinbefore mentioned, and he/she shall repay to said person the balance of said deposit, after deducting said expense.
